L’intervento prende le mosse dall’art. 9 Cost. che, nella sua versione originaria, sottolineava due direttrici fondamentali. La prima è il trittico tra il passato, definito attraverso la tutela del patrimonio culturale-artistico, la cultura e il futuro definito approssimativamente nella tutela del paesaggio. La seconda direttrice è il concetto di paesaggio in evoluzione, che continua a trasformarsi, perché l’uomo vive l’ambiente e l’ambiente vive l’uomo.Proprio da queste premesse emerge come il problema delle emergenze in materia ambientale e di salute – sempre più invadente e dirompente – e della preparazione e delle responsabilità per fronteggiarlo proponga una serie di alternative che rientrano nel complesso rapporto fra la modernità e il futuro.L’articolo 9 è all’origine del percorso per giungere alla definizione e tutela dell’ambiente come obiettivo della transizione ecologica ormai indispensabile.L’attuazione dell’assetto regionale, con la riforma del Titolo V (e i suoi molteplici limiti e problemi) sembra aver aperto la via alla valorizzazione di un secondo trittico: quello tra territorio, paesaggio e ambiente e in questa direzione, con importanti novità, sembra andare la riforma costituzionale degli artt. 9 e 41 Cost del 2022.Oggi, città, foresta e campagna – le tre grandi sfide tradizionali in tema di ambiente – sembrano un ulteriore trittico presto destinato a trasformarsi in un “pentagono” tramite l’aggiunta ai primi tre elementi dell’ambiente spaziale extra terrestre e di quello marino.
This speech takes inspiration from Article 9 of the Constitution, which, in its original version, emphasised two fundamental guidelines. The first is the triptych between the past, through the protection of the cultural-artistic heritage, culture and the future, roughly defined in the protection of the landscape. The second guideline is the concept of an evolving landscape, which transforms continuously, since mankind lives in the environment and the environment lives through mankind.From these exact premises, the problem of environmental and health emergencies – which are increasingly intrusive and disruptive – emerges, and the preparation and responsibility for dealing with them show a series of alternatives that are part of the complex relationship between modernity and the future.Article 9 is at the beginning of the path for the definition and protection of the environment as the goal of the now essential ecological transition.The implementation of the regional structure, with the reform of Title V of the Constitution (and its many limitations and problems) seems to have paved the way for the enhancement of a second triptych: the one between territory, landscape and environment, and, with important novelties, the constitutional reform of Articles 9 and 41 of the Constitution of 2022 seems to move in that direction.Today, cities, forests and the countryside – the three main traditional challenges on the matter of environment – seem another triptych soon destined to transform into a “pentagon” with the addition of the outer space environment and the marine environment to the former three elements.
