Il saggio intende ricostruire alcuni tratti portanti del pensiero di Paolo Grossi considerando il rapporto tra questi e il diritto agrario, inteso come diritto speciale, “autonomo”, caratterizzato da una sua intrinseca normatività. Grossi utilizza la «naturale storicità del diritto agrario» come una sorta di modello: i tratti riferiti al diritto agrario – effettività, antiformalismo, adesione alla “realtà delle cose” – ci mostrano un diritto impregnato di storicità e, in controluce, ci parlano della teoria del diritto che sostiene gli studi di Grossi, ricerche in cui il dato storico descrittivo è inscindibilmente connesso con quello prescrittivo-valutativo.
The Attraction of the Real. Historicity of Law in the Thought of Paolo Grossi. The paper aims to reconstruct some of the main features of Paolo Grossi’s thought by considering the relationship between these and agrarian law, understood as a special, ‘autonomous’ law, characterised by its intrinsic normativity. Grossi uses the ‘natural historicity of agrarian law’ as a model of the historicity of law: the elements referred to agrarian law - effectiveness, anti-formalism, adherence to the ‘reality of things’ - show us against the light the theory of law that underpins Grossi’s studies, research in which the descriptive historical datum is inseparably connected with the prescriptive-evaluative datum.
